Terms of service.
This page is not available yet. For anything about a purchase, write to support@fluentorg.com.
1. Who we are, and what these terms cover
FluentOrg is a product of Caldermont Management LLC (“we”, “us”), the name on your card statement and your invoice. These terms cover the site at fluentorg.com, the portal, the program’s lessons and exams, and the AI Fluency Check (together, the “Service”).
“You” means the company that uses or buys the Service, and the people it gives seats to. You agree to these terms when you create an account, start a free trial, keep a card on file or buy, each of which says so beside its button, and by using the Service. If you agree to them for a company, you confirm that you may.
2. Accounts and the free tier
Anyone can create a free account with a work email address. Free email addresses, such as Gmail, are not accepted. A free account has Foundations modules F0 and F1 and the AI Fluency Check, with nothing to pay and no end date.
Your sign-in is yours alone: do not share it. Tell us at once if you think someone else has used it.
3. The free trial
- A free trial is all of Foundations for up to 10 people for 14 days, with no card. Each person can start one.
- When a trial ends unpaid, everyone on it goes back to the free tier, with what they finished kept. Nobody else at the same company, meaning the same email domain, can start another trial for 90 days.
- From the seventh day, the trial’s administrator can keep Foundations after the trial by keeping a card on file for the first year: the number of seats they choose, at the price shown, which includes 5% off for keeping a card on file. Nothing is charged until the trial ends. Then the first year is charged to that card, and it renews as section 5 says.
- To stop that first charge, the administrator clicks Cancel renewal on the trial’s page in the portal, any time before the trial ends. Nothing is charged, and the trial ends unpaid on its own date.
- If the first charge fails, the trial ends there, and its people go back to the free tier until it is paid.
- Certificates of completion earned during a trial are held until the company pays. Until then they have no public page and their hours cannot be claimed. If the company never pays, they stay held.
4. Buying seats
- Prices are per seat, in US dollars, as the Pricing page shows them when you buy. A seat gives a year of access. Courses sold per candidate are paid once and do not renew.
- You pay by card, on Stripe’s own page. We never see your card number.
- The person who buys becomes the administrator of your organization in the portal, and gives the seats to named people. A seat is for one person at a time. Once its holder has signed in, it can be moved to someone else only by us: write to support.
- Your administrators can see each seated person’s progress and exam results, as our privacy notice explains.
5. Renewal, and how to stop it
- A yearly product bought with a card renews automatically at the end of each year, on the same card, at the price then shown, less any discount your organization has.
- We email your administrators 30 days before it renews.
- To stop a renewal, an administrator clicks Cancel renewal on your organization’s page in the portal, any time before it renews. This removes the card on file. Nothing further is charged, and your access runs to the end of the year you paid for.
- If a renewal payment fails, your access stays open for 30 days while it is paid. If it is not paid by then, access ends.
- Courses paid once do not renew.
6. The 15-day money-back guarantee
Your company’s first purchase is refunded in full if you ask within 15 days of being charged. Renewals and anything bought later are not covered. AI Cyber Security Foundations and AI Cyber Security Operations, which are paid once, are not covered. On a refund, your team’s access ends and the certificates earned under that purchase are withdrawn. The money-back guarantee page sets out exactly what it covers and how to ask, and is part of these terms.
7. Certificates of completion and study hours
- A certificate of completion can be claimed once every module in a unit is finished and its exams are passed. Anyone with its link can check it. It shows the holder’s name, never their email address.
- The hours on a certificate are the program’s stated study time. You may report them as continuing professional education to a certifying body, which decides for itself whether to accept them. We do not promise that any body will.
- We withdraw a certificate that was issued in error, or that was earned under a purchase we refunded. Its link then says it was withdrawn, and why.
- A proctored sitting of the AI Cyber Security Foundations or AI Cyber Security Operations exam, for the verified credential, is a separate purchase, bought in the portal for a named candidate in one of two modes at the prices the Pricing page shows: with a human invigilator, or under artificial intelligence (AI) proctoring, reviewed by a person. The same paper is sat in both.
- Under artificial intelligence proctoring, the candidate agrees before the sitting starts to have their identity document checked by Stripe Identity, to be recorded by camera, screen and microphone during the sitting, and to the recording being reviewed by an artificial intelligence system and decided on by a person. Our privacy notice says what is collected, how long it is kept, and how to withdraw consent. Consent may be withdrawn at any time: before the paper starts the sitting is called off and its fee refunded on request; once the paper has been opened the sitting counts as sat, is voided at the candidate’s request with no result released, and its fee is not refunded.
- A sitting its reviewer finds broke the rules, such as someone else in the room, a second device, notes, another person at the keyboard or the camera covered, is voided. Its result is not released and its fee is not refunded. The candidate may buy another sitting at the retake price and sit it 14 days after the voided one, or dispute the decision by writing to support@fluentorg.com within 90 days of the sitting, while the recording is still kept.
- A sitting bought and not used within the term of the seat it was bought for expires and is not refunded. A sitting with a human invigilator that is not attended at its booked time is a no-show, with the same consequence.
- The verified mark on a certificate records a released, passed proctored sitting. A certificate whose sitting is later found to have broken the rules is withdrawn, as one issued in error is.
8. Using the Service
Use the Service for your own people. Please do not:
- share a sign-in, or let someone without a seat use yours;
- copy, resell or republish the lessons, exams or other materials;
- try to get around what a seat opens, or to see someone else’s record;
- attack, overload or probe the Service.
We may suspend a sign-in or a seat that is used in these ways.
9. What is ours, and what is yours
The curriculum, lessons, exams and the rest of the Service are ours. While you have a seat, its holder may use them for their own learning and their own work. What you produce in your own artificial intelligence tools is yours: that work happens in your own accounts, and none of it passes through us.
10. Changes
We improve the Service, and what it contains may change. If we change these terms in a way that matters, we will email your administrators before the change takes effect. Continuing to use the Service after that means you accept the new terms.
11. Our responsibility
We provide the Service as it is, and work to keep it running and correct. As far as the law allows, we are not responsible for indirect or consequential losses, and our total responsibility to you for anything to do with the Service is limited to what you paid us for it in the 12 months before the claim.
12. Law
These terms are governed by the laws of Massachusetts, United States, without regard to its conflict-of-laws rules.
